1. Definitions
"gazetted", "we", "us", "our" refers to Public Notice Systems Ltd (trading as gazetted). "You", "your", "client" refers to the person or organisation using our services. "Service" means the statutory notice placement service provided through our platform. "Notice" means any statutory notice placed through our service.
2. Service description
gazetted provides a platform for placing statutory notices in UK newspapers and the London Gazette. We act as an intermediary between you and the relevant publications. We do not publish notices ourselves — we arrange publication on your behalf.
3. Ordering process
When you place an order through our platform, you provide the details required for your statutory notice. We generate draft notice text for your review. You are responsible for checking the accuracy of all details before approving the proof. Once a proof is approved and the notice is submitted for publication, changes may not be possible.
4. Proof approval
We will provide a proof of your notice for approval before your chosen publication date. You must review the proof carefully and approve or request amendments. Once approved, you accept responsibility for the accuracy of the notice content.
5. Publication
Following proof approval, we will arrange publication in the specified newspaper and/or the London Gazette. Publication dates depend on the newspaper's publishing schedule and are not guaranteed. We will use reasonable endeavours to place your notice in the next available edition.
6. Payment
For card payment orders, payment is taken at the time of ordering via our payment processor, Stripe. For clients on purchase order or invoice terms (as agreed with us in advance), payment is due in accordance with the agreed terms. All prices are quoted in pounds sterling and are subject to VAT at the prevailing rate (currently 20%). If we are unable to place your notice for any reason, we will refund the full amount paid.
7. Your responsibilities
You are responsible for:
- •Providing accurate and complete information for your notice.
- •Ensuring that you have the legal authority to place the notice.
- •Reviewing proofs carefully before approval.
- •Complying with all applicable legislation regarding statutory notices.
8. Liability
Our liability is limited to the fees paid for the specific order in question. We are not liable for any indirect, consequential, or special losses arising from our services, including but not limited to losses arising from late publication, errors in notice text that were approved by you, or actions of third-party publishers.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
9. Newspaper selection
We recommend newspapers based on our postcode mapping database. This recommendation is provided in good faith but we do not guarantee that any specific newspaper will be accepted by a regulatory body as the appropriate publication for your notice. If you have specific requirements, you may override our recommendation.
10. Notice text and AI-generated content
Our platform may generate suggested notice text using automated tools, including AI. Any text generated is provided as a starting point only. You are solely responsible for reviewing, editing, and approving the final notice text before publication. We do not accept liability for errors in notice text that has been approved by you.
11. Cancellation and refunds
You may cancel an order at any time, subject to the following refund schedule:
- •Before proof approval: full refund.
- •After proof approval but before submission to publisher: refund less an administration fee.
- •After submission to publisher: no refund, unless the publisher confirms cancellation.
Refunds are processed to the original payment method within 5-10 business days.
12. Intellectual property
The content of statutory notices is not our intellectual property. The gazetted platform, brand, design, and software are owned by Public Notice Systems Ltd and may not be reproduced without permission.
13. Force majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: newspaper closures, publisher insolvency, postal or delivery service disruptions, acts of God, pandemic, government action, or failure of third-party systems. In such circumstances, we will use reasonable endeavours to find an alternative publication or provide a full refund.
14. Data protection
We process your personal data in accordance with our Privacy Policy. By using our service, you acknowledge that notice text will be published in public-facing newspapers and/or the London Gazette.
15. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to terms
We may update these terms from time to time. We will notify registered users of material changes by email. Continued use of the service after changes constitutes acceptance of the updated terms.
