The legal requirement

Under the Goods Vehicles (Licensing of Operators) Act 1995, Section 11, applicants for a new HGV operator licence must publish a notice in a local newspaper circulating in the area of the operating centre. Publication is also required for the variation routes covered by the official template, including adding an operating centre or applying to keep more authorised vehicles or trailers at an existing centre. Gazetted's direct online variation route currently covers adding an operating centre only; every other variation route requires assisted wording review.

For a new licence, GOV.UK says the advert must use its official newspaper advert template. It covers the applicant's business details, operating centre address, proposed vehicle and trailer numbers, and representation wording. Each advertised variation must use the relevant section of the separate variation template linked above.

GOV.UK warns that an application may be refused if the operating centre is not advertised properly. The newspaper, timing, wording and published-page evidence all matter.

When to advertise

You must publish not earlier than 21 days before and not later than 21 days after your application submission date (s.11(2) Goods Vehicles (Licensing of Operators) Act 1995).
