The legal requirement

Under Schedule 15 paragraph 3 of the Wildlife and Countryside Act 1981, the surveying authority must advertise definitive map modification orders in a local newspaper. A notice is required both at the making stage and at confirmation.

These orders modify the definitive map and statement of public rights of way, which is the legal record of footpaths, bridleways, restricted byways, and byways open to all traffic in an area.

Objections to the order must be received within the period stated on the notice — at least 42 days from first publication (WCA 1981 Sch 15 para 3(1)(c)). Many authorities use longer windows in practice.
