The legal requirement
The Commons Act 2006 provides the framework for registering and protecting common land and town or village greens in England. When an application is made to the commons registration authority, the applicant must advertise the application in a local newspaper under the Commons Registration (England) Regulations 2014 (SI 2014/3038).
This requirement ensures that local residents and other interested parties have the opportunity to make representations or objections before the registration authority makes its decision. The notice must allow a minimum of 42 days (6 weeks) for objections, with the exact closing date set by the registration authority (SI 2014/3038 reg 23; SI 2007/457 reg 5).
Note: Wales has a separate commons registration regime. The SI 2014/3038 notification procedure applies to England only.
