The legal requirement

Under Regulation 25(b) of the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005, an applicant for a premises licence must advertise the application in a local newspaper circulating in the area of the premises.

The newspaper notice must appear within 10 working days of the day after the application is given to the licensing authority. Separately, a 28-day representation period begins the day after the application is submitted (Regulation 22) — the newspaper notice does not trigger or start that period.

If the notice is not published within the 10-working-day window — or appears in the wrong newspaper — the licensing authority may reject the application or require re-advertising. Getting the timing right matters.

Timing: two separate requirements

The 28-day representation period starts the day after the application is given to the licensing authority (Regulation 22). It runs regardless of when the newspaper notice appears.

Separately, the newspaper notice must be published within 10 working days of that same starting point (Regulation 25(b)). It does not trigger or restart the 28-day period.
