The legal requirement
Under sections 11 and 15 of the Acquisition of Land Act 1981, an acquiring authority must publish notice of the making and confirmation of a compulsory purchase order in a local newspaper circulating in the area of the land to which the order relates, and on the authority's website.
The notice must describe the land, state the effect of the order, specify the period for objections (for making notices) or the date of confirmation (for confirmation notices), and indicate where the order and map may be inspected.
Failure to comply with the publication requirements can render the CPO vulnerable to legal challenge, making correct and timely advertisement essential.
