Section 27 probate notices

Without a Section 27 notice, personal representatives (executors or administrators) who distribute the estate may be held personally liable for valid claims they did not know about. The legal requirement

Section 27 of the Trustee Act 1925 provides that personal representatives who give notice of their intention to distribute the estate — and then distribute after the expiry of the notice period — are not liable to any person of whose claim they did not have notice at the time of distribution.

Section 27 requires notice in the London Gazette. Where the deceased held land or property, a notice must also be placed in a newspaper circulating in the relevant district. In practice, both placements are recommended for any estate of meaningful value. The notice must give a minimum of 2 months for claimants to come forward.
