What planning notices we place for councils

Gazetted handles the newspaper publication leg of an LPA's statutory planning publicity. The Article 15 site-display duty remains with the council; we cover the printed-newspaper requirement under DMPO 2015 Art. 15(3)(b) and the equivalent provisions for listed-building consent (PLBCAA 1990 s.67) and conservation-area consent (PLBCAA 1990 s.73).

We publish:

  1. Major-application publicity — under DMPO 2015 Art. 15 (made under TCPA 1990 s.65). Required for EIA applications accompanied by an environmental statement, departures from the development plan, and applications affecting public rights of way.
  2. Article 4 direction notices — making and confirmation, under GPDO 2015 (SI 2015/596) Sch 3 paragraph 1. Local-advertisement duty falls on the LPA “as soon as practicable” after the direction is made.
  3. Listed-building consent application publicity — under PLBCAA 1990 s.67. 21-day inspection window from date of publication, in a newspaper circulating in the locality of the building.
  4. Conservation-area consent application publicity — under PLBCAA 1990 s.73 (extending the s.67 duty to demolition applications affecting unlisted buildings within a conservation area).

What we do not handle

  • Site-display notices. DMPO 2015 Art. 15(3)(a) places the site-display duty on the LPA directly; we do not print or affix on-site notices.
  • Planning-application appeals. TCPA 1990 s.78 appeals to the Secretary of State are a separate process; we do not advertise appeal hearings.
  • The London Gazette leg of conservation-area designations. PLBCAA 1990 s.70(8) places the Gazette duty “by that authority” — the LPA files directly with thegazette.co.uk. See conservation-area notices for the local-newspaper leg.
  • Pre-application consultation. TCPA 1990 s.71 consultation duties with statutory bodies are an LPA-internal workflow; we do not service those.
